ACCEPTABLE USE POLICY

This Acceptable Use Policy (“Policy”) describes the permitted and prohibited uses of the Nygma.ai service (“Service”) operated by Genie9 LTD (“Genie9”, “we”, “us”, or “our”), a company registered in England and Wales with company registration number 08669198.

This Policy forms part of our Terms of Service and End User License Agreement (EULA). All capitalized terms not defined in this Policy have the meanings set forth in the Terms of Service and EULA.

BY USING THE SERVICE, YOU AGREE TO COMPLY WITH THIS POLICY. VIOLATION OF THIS POLICY MAY RESULT IN SUSPENSION OR TERMINATION OF YOUR ACCESS TO THE SERVICE.

1. PURPOSE

1.1 Policy Objectives. This Policy is designed to:

  • Ensure the Service is used lawfully and responsibly
  • Protect the rights and interests of all users and third parties
  • Maintain the security, reliability, and integrity of the Service
  • Comply with legal and regulatory requirements

1.2 Zero-Knowledge Context. Genie9 acknowledges that due to the zero-knowledge encryption architecture of the Service:

  • We cannot monitor or access your Content
  • We cannot proactively detect violations of this Policy
  • Enforcement relies primarily on reported violations

1.3 User Responsibility. You are solely responsible for ensuring your use of the Service complies with this Policy, even though we cannot monitor your Content.

2. PROHIBITED USES

2.1 Illegal Activities. You may not use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Plan or engage in any illegal activity
  • Store, upload, or share any Content that is unlawful or promotes unlawful activities

2.2 Harmful Content. You may not use the Service to store, upload, or share Content that:

  • Depicts, describes, or encourages violence against any individual or group
  • Contains child sexual abuse material or any Content that exploits or harms minors
  • Contains non-consensual intimate imagery (revenge pornography)
  • Promotes terrorism or violent extremism
  • Contains malware, viruses, or any other malicious code
  • Is designed to harass, threaten, or stalk any individual

2.3 Intellectual Property Violations. You may not use the Service to:

  • Infringe the intellectual property rights of others
  • Share Content that you do not have the right to share
  • Distribute copyrighted material without proper authorization

2.4 Service Interference. You may not:

  • Interfere with or disrupt the Service or servers or networks connected to the Service
  • Attempt to access parts of the Service or related systems that you are not authorized to access
  • Use any robot, spider, or other automated system to access the Service
  • Engage in any activity that places excessive load on our infrastructure

2.5 Fraudulent or Deceptive Activities. You may not use the Service to:

  • Engage in fraudulent activities or misrepresentation
  • Impersonate any person or entity
  • Distribute spam or unwanted communications
  • Engage in phishing or other deceptive practices

2.6 Commercial Restrictions. You may not use the Service to:

  • Resell the Service or access to the Service
  • Use the Service for high-risk activities where failure could lead to death, personal injury, or severe environmental damage

3. STORAGE AND BANDWIDTH USAGE

3.1 Fair Usage. You agree to use the Service’s storage and bandwidth resources reasonably and within the limits of your subscription plan.

3.2 Prohibited Storage Practices. You may not:

  • Artificially manipulate files to circumvent storage limitations
  • Use the Service as a backup or redundant storage for commercial content delivery networks
  • Upload identical Content repeatedly to increase your storage artificially

3.3 Automated Access. Automated or programmatic access to the Service must:

  • Comply with our published API documentation and limitations
  • Not exceed reasonable request rates
  • Not attempt to circumvent any rate limiting mechanisms

4. ACCOUNT SECURITY

4.1 Account Protection. You are responsible for maintaining the security of your account and must:

  • Use strong, unique passwords
  • Enable two-factor authentication when available
  • Not share your account credentials with others
  • Not allow unauthorized users to access your account

4.2 Security Feature Usage. If you use advanced security features such as Duress Mode or Time Bomb:

  • You must use them in accordance with their intended purpose
  • You must not configure them in a way that poses a risk to others

4.3 Security Vulnerabilities. If you discover a security vulnerability in the Service, you must:

  • Report it to us promptly at security@genie9.com
  • Not exploit the vulnerability or disclose it publicly before we have had a reasonable time to address it

5. CONTENT SHARING

5.1 Sharing Responsibility. When sharing Content through the Service, you:

  • Must ensure you have the right to share that Content
  • Are responsible for who you share Content with
  • Must ensure shared Content does not violate this Policy

5.2 Commercial Sharing Limitations. You may not use the Content sharing features of the Service to:

  • Operate a public file sharing service
  • Distribute Content to the general public as a content distribution network
  • Circumvent paid content distribution systems

6. REPORTING VIOLATIONS

6.1 Reporting Process. If you become aware of a violation of this Policy, you should report it to:

  • Email: support@genie9.com
  • Subject: “AUP Violation Report”

6.2 Required Information. When reporting a violation, please provide:

  • A description of the violation
  • Any supporting evidence you can legally share
  • Your contact information for follow-up

6.3 False Reports. Knowingly making false reports of violations is itself a violation of this Policy.

7. ENFORCEMENT

7.1 Investigation. Upon receiving a report of a potential violation, we will:

  • Investigate the report to the extent possible given our zero-knowledge architecture
  • Make a determination based on available evidence
  • Take appropriate action if a violation is confirmed

7.2 Enforcement Actions. If we determine that a violation has occurred, we may take one or more of the following actions:

  • Issue a warning
  • Temporarily suspend your account
  • Permanently terminate your account
  • Remove publicly shared Content that violates this Policy
  • Report the violation to appropriate authorities if required by law

7.3 Zero-Knowledge Limitations. Due to our zero-knowledge encryption architecture:

  • We cannot access, review, or remove your private encrypted Content
  • Enforcement actions related to private Content rely on external evidence
  • We can only remove publicly shared Content that has been reported and verified as violating this Policy

7.4 Appeal Process. If you believe an enforcement action was taken in error, you may appeal by contacting support@genie9.com with the subject “AUP Enforcement Appeal.”

8. COOPERATION WITH AUTHORITIES

8.1 Legal Compliance. Genie9 cooperates with law enforcement and other authorities when required by law.

8.2 Zero-Knowledge Limitations. In the event of a legal request for user Content:

  • We can only provide encrypted data, which remains unreadable without your encryption keys
  • We cannot provide decrypted Content as we do not have the technical capability to decrypt it
  • We will notify users of legal requests when permitted by law

8.3 User Responsibility. You are responsible for complying with all applicable laws regarding your Content, regardless of our technical inability to access it.

9. CHANGES TO THIS POLICY

9.1 Policy Updates. We may update this Policy from time to time. We will notify you of significant changes through the Service or via email.

9.2 Continued Use. Your continued use of the Service after such notification constitutes acceptance of the updated Policy.

10. INDEMNIFICATION AND LIABILITY

10.1 Indemnification. You agree to indemnify and hold harmless Genie9, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising from your violation of this Policy.

10.2 Limitation of Liability. IN NO EVENT SHALL GENIE9’S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THIS POLICY EXCEED ONE HUNDRED U.S. DOLLARS ($100.00), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT, OR OTHERWISE.
